1 Scope and Responsible Entity

This Privacy Policy explains how Verifact Markets, LLC, referred to as “Verifact,” “we,” “us,” or “our,” collects, uses, discloses, and otherwise processes personal information through our websites, applications, trading platform, Trading Wallet, APIs, market data, evidence and commenting features, customer support, and other services that link to this Policy, collectively the “Services.”

Verifact Markets, LLC is the entity responsible for the processing described in this Policy, except where a third party independently determines how it processes information under its own privacy policy. This Policy does not replace the privacy notices of wallet, identity, payment, blockchain, advertising, or other third-party services.

2 Information We Collect

Information You Provide

  • Account and contact information, such as email address, display name, avatar, communication preferences, and account settings.
  • Identity and eligibility information that we may request directly or receive from verification providers, such as legal name, date of birth, address, nationality, government identification information, sanctions-screening results, entity formation information, authorized representatives, and beneficial owners.
  • Trading and financial information, such as wallet addresses, funding and withdrawal instructions, USDC balances visible to the Services, orders, trades, positions, settlements, expirations, rewards, fees, transaction history, and limited payment-method or funding-source information. Payment and verification providers may collect sensitive financial or identity information without providing the complete underlying information to Verifact.
  • Evidence submissions, including sources, links, files, explanations, communications, and associated metadata. We also maintain information connecting a submission to the contributor even when that relationship is not displayed publicly.
  • Public profile and community content, including display names, avatars, comments, reactions, and other material a user chooses to post publicly.
  • Communications and support information, including messages, complaints, survey responses, feedback, promotion entries, and records associated with security or dispute resolution.
  • Entity and market-maker information, including organizational documents, authorized-user information, beneficial-owner information, financial-resource information, agreements, performance data, and compliance records.

Information Collected Automatically

  • Device and log information, such as IP address, browser, operating system, device type, device identifiers, language, time zone, access times, referring pages, crash records, and security logs.
  • Usage information, such as pages viewed, features used, clicks, searches, orders initiated, session activity, interactions with content, and communications with the Services.
  • Approximate location inferred from an IP address and related technical information. Verifact may collect more precise location information in the future only with device permission or other notice and consent required by law.
  • Cookie and similar technology data used for authentication, preferences, analytics, fraud prevention, advertising measurement, interest-based advertising, and retargeting.
  • Trading, wallet, and blockchain information obtained from public ledgers, smart contracts, blockchain analytics providers, and other sources used to operate and protect the Services.

Information From Other Sources

  • Wallet, authentication, identity-verification, payment, funding, exchange, and on-ramp or off-ramp providers.
  • Analytics, advertising, attribution, fraud-prevention, sanctions-screening, cybersecurity, and market-surveillance providers.
  • Linked services, login providers, marketing partners, professional advisers, counterparties, and affiliates.
  • Public records, public websites, blockchain data, government lists, news sources, and other lawfully available information relevant to eligibility, security, evidence, or market integrity.

3 Public Private and Blockchain Information

Public Information

A user’s selected display name, avatar, and public comments are visible to other users and may be indexed, copied, or redistributed by others. Admitted evidence, links, excerpts, descriptions, and Verifact’s related analysis may also be published through the Services.

Evidence Contributor Information

Verifact does not publicly display the contributor’s verified legal identity or publicly identify the contributor as the source of an evidence submission unless the contributor consents. Verifact may internally associate the contributor with the submission and disclose that information to service providers, professional advisers, or authorities when reasonably necessary for the purposes described in this Policy or required by law.

Blockchain Information

Base and other public blockchains permanently record wallet addresses, transactions, token balances, smart-contract interactions, and related information. That information is public and may remain available after an account is closed or a deletion request is completed. Verifact cannot delete or alter information written to a public blockchain by independent network participants.

4 How We Use Information

Verifact may use personal information to:

  • Create, authenticate, maintain, secure, and support accounts and Trading Wallets.
  • Process deposits, withdrawals, orders, trades, collateral movements, settlements, expirations, fees, rewards, and related records.
  • Determine eligibility, perform verification, enforce geographic restrictions, screen for sanctions, and comply with legal obligations.
  • Operate the order book, administer Markets, review evidence, perform evidence and market-microstructure analysis, support the Market Resolution team, and explain resolutions and expirations.
  • Detect, investigate, prevent, and address fraud, manipulation, self-dealing, account compromise, prohibited trading, unlawful conduct, security incidents, and violations of our terms or Market Rules.
  • Provide customer support, respond to requests, send transactional and security communications, and administer complaints or disputes.
  • Personalize and improve the Services, conduct analytics and research, test features, and develop or improve Verifact’s analytical systems. Where reasonably practicable, Verifact may use aggregated or deidentified information for these purposes.
  • Send marketing communications, measure campaigns, deliver interest-based advertising, retarget users on other services, and understand how users engage with Verifact and its advertising.
  • Create and display public profiles and comments, publish admitted evidence, and feature public comments with the associated display name and avatar in Verifact marketing.
  • Enforce agreements, protect legal rights, conduct audits, support corporate transactions, and establish, exercise, or defend legal claims.
  • Carry out another purpose disclosed when the information is collected or authorized by the user.

5 Legal Bases Where Required

Where applicable law requires a legal basis for processing, Verifact relies on one or more of the following bases:

  • Contract, when processing is necessary to create an account, provide the Services, execute transactions, administer Markets, or fulfill our agreements.
  • Legal obligation, when processing is necessary to comply with laws, sanctions, court orders, lawful requests, tax duties, recordkeeping, or other binding requirements.
  • Legitimate interests, including securing the Services, preventing fraud and manipulation, enforcing platform rules, improving products, communicating with users, conducting analytics, and operating a sustainable business, balanced against applicable user rights.
  • Consent, where we request permission for precise location, certain cookies, marketing, or another activity for which consent is required. A user may withdraw consent prospectively, subject to applicable law.
  • Protection of vital interests or performance of a task in the public interest where those bases lawfully apply.

6 How We Disclose Information

Verifact may disclose personal information to:

  • Wallet, authentication, identity, compliance, funding, payment, blockchain, hosting, cloud, communications, customer-support, analytics, advertising, attribution, cybersecurity, fraud-prevention, market-surveillance, tax, and other service providers that support the Services.
  • Affiliates that provide operational services or liquidity, subject to contractual, access, and information-barrier controls. The affiliated market maker may receive information necessary to participate on the same terms as other participants but is not permitted to receive confidential user identities, nonpublic order flow, nonpublic evidence, resolution analysis, or pending resolution decisions for trading purposes.
  • Public blockchain networks and smart contracts when transactions are submitted, executed, or settled.
  • Other users and the public when information is part of a public profile, comment, admitted evidence record, market display, public transaction record, or other feature the user understands to be public.
  • Professional advisers, auditors, insurers, financing sources, and transaction participants subject to appropriate confidentiality obligations.
  • Governmental, regulatory, judicial, law-enforcement, or other authorities when Verifact reasonably believes disclosure is required or appropriate to comply with law, protect rights or safety, investigate misconduct, or respond to lawful process.
  • A buyer, investor, lender, successor, or other participant in an actual or proposed merger, financing, reorganization, asset transfer, change of control, insolvency, or similar corporate transaction.
  • Another person at the user’s direction, with consent, or as otherwise disclosed when information is collected.

Verifact does not sell personal information to third parties for monetary payment. Some privacy laws may define the use of advertising cookies or disclosure of identifiers for interest-based advertising as a “sale,” “sharing,” or targeted advertising even when no money is exchanged. Users may exercise applicable opt-out rights as described below.

7 Advertising Analytics and Cookies

Verifact and its partners may use cookies, pixels, software development kits, device identifiers, hashed contact information, and similar technologies to authenticate users, remember preferences, understand use of the Services, measure campaigns, prevent fraud, deliver interest-based advertising, and retarget users on other websites or applications.

Advertising, analytics, and social-media partners may collect information about a user’s activity over time and across devices or services. Verifact may share a common identifier, such as a user ID, email address, or hashed email address, to support attribution, measurement, audience matching, analytics, and advertising. The specific technologies and partners may change as the Services evolve.

Where required, Verifact will request consent before using nonessential cookies or similar technologies. Browser, device, cookie-banner, advertising-industry, and legally recognized opt-out tools may allow users to control certain processing. Choices may apply only to the browser or device on which they are made, and disabling technologies may affect Service functionality.

8 Communications Choices

Users may opt out of promotional emails by using the unsubscribe link or contacting Verifact. Users cannot opt out of transactional, account, legal, security, market, or service communications that are necessary to provide or protect the Services. Device settings may control push notifications and precise-location permissions.

9 Data Retention and Account Closure

Verifact retains personal information for as long as reasonably necessary to provide the Services, administer Markets and transactions, maintain security and market integrity, comply with law, resolve disputes, enforce agreements, support audits, and establish or defend legal claims. Retention periods vary according to the type of information, purpose, sensitivity, legal requirements, and risk.

A user may request account closure through the available account controls or by contacting Verifact. Open orders may need to be canceled, positions sold or held through resolution or expiration, and available funds withdrawn before closure can be completed. Verifact may retain information after closure when required or permitted for legal, security, fraud-prevention, market-integrity, tax, accounting, dispute, or recordkeeping purposes.

Account closure or deletion does not remove public blockchain records or copies of public information retained by other users, search engines, archives, or independent third parties. Verifact may retain deidentified or aggregated information that no longer reasonably identifies a person and will not attempt to reidentify it except as permitted by law.

10 Information Security

Verifact uses administrative, technical, and organizational safeguards designed to protect personal information. No system, wallet, blockchain, transmission method, or storage service is completely secure. Users are responsible for protecting their devices, login methods, recovery credentials, and any wallet information under their control and for promptly reporting suspected compromise.

11 Privacy Rights and Requests

Depending on applicable law, a user may have rights to request access, confirmation, correction, deletion, restriction, portability, or a copy of personal information; to object to certain processing; to withdraw consent; to opt out of targeted advertising, sale, sharing, or qualifying profiling; and to appeal a denied request. A user may also have the right to complain to a data-protection or consumer authority.

To exercise a privacy right, contact support@verifact.markets. Verifact may request information reasonably necessary to verify identity, account ownership, location, and authority. An authorized agent may submit a request where permitted, subject to verification of the agent’s authority. Verifact may deny or limit a request when an exception applies, including when information must be retained for legal compliance, fraud prevention, security, market integrity, transaction records, disputes, or the rights of others.

Verifact will not unlawfully discriminate against a user for exercising a privacy right. Some information is necessary to provide the Services, and deleting or restricting it may require account closure or make certain features unavailable.

12 International Data Transfers

Verifact is based in the United States and may process information in the United States and other countries where it or its service providers operate. Those countries may have privacy laws different from the laws where the user resides. Where required, Verifact will use an approved transfer mechanism or other legally recognized safeguard for cross-border transfers.

13 Children and Age Restrictions

The Services are not intended for anyone under 18. Verifact does not knowingly permit a person under 18 to create an account or trade. If Verifact learns that it collected personal information from a person under 18 in violation of this Policy, it will take appropriate steps to delete or restrict that information, subject to legal retention requirements.

14 Third Party Services and Links

Third-party wallet, identity, funding, payment, exchange, blockchain, social-login, advertising, analytics, and linked services process information under their own terms and privacy policies. Verifact does not control their independent practices. Users should review those notices before providing information or connecting a service.

15 Changes to This Policy

Verifact may update this Policy to reflect changes in the Services, technology, law, or information practices. Verifact will post the revised Policy with an updated effective date and provide additional notice when required by law. Material changes apply prospectively unless law permits otherwise.
